General Terms and Conditions
SCOPE OF APPLICATION
All orders placed through our online shop shall be governed by the following General Terms and Conditions.
CONTRACTING PARTIES, CUSTOMER SERVICE
The contract of sale is between you and beautyalchymist.com legally represented by MAPEON s.r.o., Pujmanové 1753/10a, 140 00 Prague, ID 08861650. Further information about us can be found in the Legal Notice. In the event of any questions, complaints, or objections you can contract Customer Service under the telephone number.
CONCLUSION OF THE PURCHASE CONTRACT
The conclusion of the purchase contract is only available in English language.
The presentation of products in our online shop is not a legally binding offer but a non-binding online catalogue. You may select desired items of the products presented in our online shop by clicking the button “IN YOUR SHOPPING BAG” and add these items to the so called “shopping bag”. In our overview pages displaying several products you may have the option to use our “Quick Shop”-tool. When hovering your computer mouse over the displayed product image the “Quick Shop”-button appears. Clicking this button will open a separate window providing you with the possibility to add the item to you shopping bag directly by an additional click on the “shopping bag symbol”.
You may find the “shopping bag”-button above the navigation bar. It is represented by an icon shaped as a shopping bag. The current content of your shopping bag will be displayed when hovering over this button. Furthermore, the buttons “SHOPPING BAG” and “CHECKOUT” will appear. By clicking the button “SHOOPING BAG” you can access your shopping bag and make changes to your order at any time, in particular, you will be able to remove selected items from the shopping bag. When clicking the button “CHECKOUT” you will have the option to log in to your customer account or to continue as guest, or to log in to your payment service provider account such as “amazon pay” or “PayPal”. You will then access the order summary. You may add your personal information and choose between the available payment methods and shipping options. You are free to modify and correct the details of your order, or to cancel the purchase until you click the button „CHECKOUT“.
Please note, when using the services of a payment service provider such as „PayPal“ you may be directed to the website of your payment service provider first before accessing our order summary page. If you are directed to your payment service provider’s website please enter the details required by your payment service provider. Afterwards you will be redirected to our online shop’s order summary page. You are free to modify and correct the details of your order, or to cancel the purchase until you click the button „CHECKOUT“. By clicking the button “CHECKOUT” you submit a legally binding offer to conclude a purchase agreement. We will send you a receipt of your order via email immediately after your submission including the details of your order. This receipt of your order does not constitute an acceptance of your offer. We may accept your offer via an email confirmation of order or by delivery of the goods within five days after your submission.
The text of these general terms and conditions will not be saved after concluding the purchase contract. You may access the current version of our general terms and conditions through our online shop. Additionally, you have the possibility to access and print out or save electronically our general terms and conditions via your internet browser before submitting your order.”
STATUTORY DEFECT WARRANTY
We are liable for material defects and legal defects of the goods in line with the applicable statutory provisions, including Sections 434 of the EU Civil Code (BGB). With respect to B2B customers (entrepreneurs) the seller’s defect warranty period for goods ends 12 months after delivery of the goods.
SHIPPING COSTS
We ship Monday to Friday excluding public holidays.Shipping costs will be added to the prices quoted for the products.
INTERNATIONAL SHIPPING
We have partnered with relied global partners (DPD, UPS, PPL) to ship beautyalchymist.com orders to eu countries from our international website. Delivery times, costs and duties are dependent on your shipping location and will be displayed at checkout. Other shipments upon individual request.
DELIVERY TIME
We usually dispatch orders within within 2 to 4 working days.
PAYMENT OPTIONS
Debit, Credit Card, cash on delivery (C.O.D.) or advance payment on invoice.
Debit
Your debit card account will be debited on completion of the order. This service is operated by Shoptet pay. You don’t have to have a Shoptet pay account.
Credit card
Your credit card account will be debited on completion of the order.This service is operated by Shoptet Pay. You don’t have to have a Shoptet pay account.
On invoice payment in advance
If you select “Payment on Invoice” as the payment method we will give you invoice with our bank account details in the order confirmation and deliver the goods on receipt of payment. Please note that we can reserve your order including beauty deals for a maximum of 7 days from the order date.
Cash on delivery (C.O.D.)
If you select cash on delivery (C.O.D.) as the payment method there will be an extra charge of €5.
COLLECTION BY THE CUSTOMER
We mainly deliver through our shipment partners. It is also possible for you to collect the goods yourself at our headquarter stock with no extra costs.
BEAUTY DEALS
For all conditions concerning each beauty deal, please look directly on the beauty deals site.
The combination possibilities differ between various promotion codes. Unless otherwise specified, promotions are valid while stocks last. Perfume samples do not count as orders that include free items. Errors and omissions excepted. If the order is returned in full or in part, free items must be returned in full.
BA VOUCHER
Please note that no percentage promotional discounts can be redeemed on the purchase of a BA Voucher and the BA Voucher value will be excluded from Beauty Deals. If you purchase an e-voucher only, an email will be sent with the corresponding voucher code generated once it has been paid for. The dispatch of free samples is therefore excluded.
INSTAGRAM GIVEAWAYS
The organizer and person responsible for conducting the giveaway is beautyalchymist.com.
The giveaway is not affiliated with Instagram and is in no way sponsored, promoted or organized by Instagram. Any questions, comments or complaints regarding the giveaway should be directed to beautyalchymist.com, not to Instagram.
We process your data (name and address) for contacting the winners and for sending the prizes. After completion of the competition, your data stored with us will be stored for 3 years from the end of the calendar year. The legal basis for the data processing is Art. 6 para. 1 b) DSGVO in connection with the contract. You have the right to free information about your personal data stored by us. If the legal requirements are met, you also have the right to have this data corrected, blocked or deleted. You also have the right to receive from us the personal data concerning you that you have provided to us in a structured, common and machine-readable format; you can then transfer this data to other bodies or have it transferred. You also have the right to lodge a complaint with the competent supervisory authority for data protection. If you have any questions about data protection, please feel free to contact at any time.
RIGHT OF CANCELLATION
INFORMATION CONCERING THE RIGHT OF CANCELLATION
According to section 13 of the EU Civil Code (BGB) a consumer is any natural person who enters into a legal transaction for purposes that can largely be counted as neither a commercial nor an independent professional activity.
Right of Cancellation
The cancellation period is fourteen days from the date when you or a third party designated by you who is not the carrier has taken possession of the goods.
We may refuse to make a refund until the goods have been returned to us or until you have proved that you have returned the goods, whichever is earlier.
You must send or hand over the goods to us immediately and in any case no later than within fourteen days of informing us that you intend to cancel this contract. You will have complied with the time limit if you send the goods before the fourteen-day period has expired.
You only have to reimburse us for any loss in the value of the goods if this loss of value has been caused by handling the goods in a way that is not necessary in order to inspect their condition, characteristics, and functionality.
Please note: a 100 percent refund of your return can only be made if the items arrive in their original packaging and unused. For used items we reserve the right to withhold a part of the refund amount. Please also note that we can only take back hygiene articles (vibrators and cone trainers) which still have the existing seal and which are not defective. The return of vouchers and e-vouchers is also excluded.
All refunds will be returned no later then 14 days after receiving your cancellation form.
Exclusion of the right of cancellation
In the following cases, you do not have a right of cancellation for contracts:
for the supply of goods that are not prefabricated and which are produced in accordance with the consumer’s individual choices or specifications or that are obviously tailored to the consumer’s personal requirements,
for the supply of goods that may rapidly spoil or whose use-by date would soon be passed,
for the supply of sealed goods which are unsuitable for return for reasons of health or hygiene if their seal has been removed after delivery,
for the supply of goods that, due to their condition, have been inseparably combined with other goods after delivery, for the supply of perfume samples
